AFM Terms of Use

1. Agreement to Terms

By accessing or using AFM, you agree to these Terms of Use.

You confirm that:

• You are at least 18 years old, or you have the consent of a parent or legal guardian who has authority to bind you to these Terms.
• You have the legal capacity and authority to enter into this agreement.
• You understand and accept the risks associated with using a digital platform for records, communication, storage, exports, and related functions.

2. Description of Service

AFM is a financial record-keeping and communication platform that may include features such as:

• Manual transaction and record tracking, including sales, purchases, and inventory
• Currency recording and exchange rate display
• Text messaging, voice messaging, attachments, and other communication features
• QR-based user identification or connection features
• PDF generation, receipts, statements, and other document output tools
• Cloud-based storage, synchronization, and backup-related functions
• Authentication methods including phone number, password, and OTP verification flows

AFM is not, and does not represent itself as:

• A bank or deposit-taking institution
• A payment processor or money transmitter unless separately stated in writing
• A licensed financial institution
• A provider of accounting, investment, legal, tax, or regulatory advice

3. User Acknowledgement and Assumption of Risk

You acknowledge and agree that:

• All records, messages, attachments, labels, notes, totals, calculations, and outputs may be based fully or partly on information entered by users.
• Mozayel LLC does not independently verify the truth, completeness, legality, validity, or accuracy of information entered into the Service.
• Automated calculations, summaries, exports, receipts, statements, timestamps, and other outputs may contain errors, inconsistencies, delays, duplication, omissions, or formatting issues.
• You are solely responsible for independently reviewing and verifying all information before relying on it for any personal, business, financial, legal, tax, inventory, operational, or compliance decision.

You use the Service at your own risk. You must not rely exclusively on AFM for bookkeeping, accounting, tax filing, regulatory compliance, legal obligations, operational decisions, customer disputes, or financial decision-making.

4. No Professional, Financial, Legal, or Tax Advice

Nothing in the Service constitutes or should be interpreted as:

• Accounting advice
• Financial advice
• Investment advice
• Legal advice
• Tax advice
• Regulatory or compliance advice

Any charts, summaries, records, receipts, statements, calculations, filters, exports, and other outputs are provided for informational and organizational purposes only. You are solely responsible for consulting qualified professionals where needed.

5. Account Registration, Credentials, and Authentication

You are solely responsible for:

• Maintaining the confidentiality of your login credentials and authentication methods
• All activity that occurs under your account
• Securing your phone, device, email, SIM card, network access, authentication channels, and backups
• Ensuring that the phone number and other account information associated with your account remain accurate and under your control

AFM may use phone-based authentication, passwords, OTP, and other verification methods. Such methods depend on external providers, device security, telecom infrastructure, app permissions, internet connectivity, and other factors outside Mozayel LLC’s control.

Mozayel LLC is not responsible for:

• Delayed, failed, intercepted, duplicated, or misdirected OTP or verification messages
• Unauthorized access resulting from stolen devices, compromised accounts, shared credentials, SIM-swap attacks, phishing, malware, or user negligence
• Account lockouts, verification failures, or inability to access the Service caused by third-party systems or user-side issues

6. User Data and Record Responsibility

You are solely responsible for:

• All content, data, records, transaction details, inventory information, descriptions, files, attachments, and communications that you create, upload, send, receive, store, or manage through AFM
• Ensuring the accuracy, completeness, legality, and appropriateness of that information
• Maintaining any backups you consider necessary
• Reviewing exported documents, receipts, statements, and summaries before using or sharing them

Mozayel LLC does not guarantee:

• The accuracy, completeness, or validity of any data stored through the Service
• The preservation, recoverability, or ongoing availability of any data
• That calculations, summaries, searches, filters, or exports will be error-free or fit for your intended purpose

7. Chat, Messaging, QR, and User Interactions

AFM may provide messaging, voice, attachment sharing, QR-based identification, or other user interaction features.

You acknowledge and agree that:

• Mozayel LLC does not guarantee the identity, honesty, reliability, legality, or conduct of any user.
• Mozayel LLC does not guarantee that messages, files, QR connections, or communications will be delivered successfully, delivered on time, delivered only once, or remain retrievable.
• Mozayel LLC does not verify all user content and is not responsible for the truthfulness, quality, legality, or safety of user communications or interactions.
• Any interaction with another user, customer, vendor, business, or third party is at your own risk.

Mozayel LLC is not liable for:

• Fraud, scams, impersonation, harassment, abuse, threats, or misrepresentation by users or third parties
• Commercial, financial, contractual, or personal disputes between users
• Losses arising from reliance on messages, attachments, QR scans, contact information, or representations made by users

8. PDF Generation, Receipts, Statements, and Other Documents

AFM may generate receipts, statements, PDFs, summaries, and other output documents based on user data or system-generated formatting.

You acknowledge and agree that:

• All such documents depend on information supplied by users or by system logic that may be incomplete, inaccurate, delayed, corrupted, or outdated.
• Generated documents are not audited, certified, guaranteed, notarized, or independently verified by Mozayel LLC.
• Formatting, totals, currency displays, timestamps, status labels, line items, and document details may contain mistakes or may not reflect current facts.

Mozayel LLC is not responsible for:

• Financial discrepancies
• Tax errors
• Accounting disputes
• Legal disputes arising from generated documents
• Any reliance you or others place on generated documents

9. Third-Party Services, Infrastructure, and Dependencies

AFM may depend on or integrate with third-party service providers, infrastructure providers, APIs, communication providers, storage systems, hosting environments, monitoring tools, and related services.

Mozayel LLC is not responsible for:

• Failures, outages, delays, suspensions, security incidents, or changes in third-party services
• Data loss, corruption, unavailability, duplication, or delivery failure caused by third-party systems
• Business losses or user harm resulting from downtime, API errors, infrastructure failure, service degradation, or configuration issues involving third-party services

10. Service Availability, Changes, and Discontinuation

You understand and agree that the Service may:

• Be interrupted, degraded, delayed, restricted, or unavailable at any time
• Contain bugs, glitches, crashes, errors, or unexpected behavior
• Be modified, updated, limited, suspended, or discontinued at any time, with or without notice
• Lose compatibility with certain devices, regions, operating systems, carriers, or integrations

Mozayel LLC has no obligation to provide continuous uptime, uninterrupted functionality, permanent storage, backward compatibility, or ongoing support for any specific feature.

11. Data Loss, Security Disclaimer, and Technical Risk

You acknowledge and agree that:

• No application, server, infrastructure provider, device, or communication system can be guaranteed to be fully secure.
• Unauthorized access, hacking, malware, data loss, corruption, misrouting, accidental deletion, service outages, and security incidents may occur despite reasonable precautions.
• Mozayel LLC cannot guarantee absolute confidentiality, integrity, availability, accuracy, or recoverability of information.

To the maximum extent permitted by law, Mozayel LLC is not liable for:

• Data loss or corruption
• Unauthorized access or breaches
• Failures in backup or recovery
• Interrupted, incomplete, delayed, duplicated, or missing records or messages
• Consequences of device compromise, weak passwords, shared accounts, phishing, social engineering, network interception, or other user-side vulnerabilities

12. Acceptable Use

You agree not to:

• Use AFM for unlawful, fraudulent, abusive, deceptive, or harmful purposes
• Upload, transmit, store, or share false, misleading, malicious, infringing, or illegal content
• Attempt to hack, disable, overload, reverse engineer, scrape, probe, or exploit the Service or its infrastructure
• Interfere with other users’ access, privacy, security, or lawful use of the Service
• Use the Service in a manner that violates third-party rights, sanctions laws, export restrictions, local laws, or regulatory requirements

Mozayel LLC may investigate suspected misuse and may suspend, restrict, remove content from, or terminate accounts at any time if misuse is suspected.

13. Intellectual Property

Mozayel LLC and its licensors own all right, title, and interest in and to the Service, including the app, software, design, branding, features, visual layout, code, text, graphics, logos, trademarks, content organization, and other platform materials, except for user content owned by users.

Subject to these Terms, Mozayel LLC grants you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, lease, sublicense, decompile, reverse engineer, or exploit any part of the Service except as expressly permitted by law or with Mozayel LLC’s written consent.

14. User Content License

You retain ownership of your user-generated content to the extent you have legal rights in that content. However, by uploading, submitting, storing, transmitting, or creating content through AFM, you grant Mozayel LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, format, transmit, display, and use that content solely for the purposes of operating, securing, supporting, improving, backing up, troubleshooting, and providing the Service.

You represent and warrant that you have the rights necessary to provide that content and to grant this license.

15. No Warranty

To the maximum extent permitted by law, the Service is provided on an “as is,” “as available,” and “with all faults” basis. Mozayel LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, availability, reliability, and freedom from viruses or harmful code.

Mozayel LLC does not warrant that:

• The Service will meet your needs or expectations
• The Service will be uninterrupted, error-free, secure, or compatible with your systems
• Any defects will be corrected
• Any data will remain available, preserved, accurate, or recoverable

16. Limitation of Liability

To the maximum extent permitted by law, Mozayel LLC, its owners, officers, managers, employees, contractors, affiliates, licensors, service providers, successors, and assigns shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, or for any loss of profits, revenue, business, goodwill, opportunity, data, contracts, reputation, savings, or use, arising out of or relating to the Service, these Terms, or your use of or inability to use the Service, even if advised of the possibility of such damages.

This limitation applies to claims based on contract, tort, negligence, strict liability, statute, misrepresentation, or any other legal theory, including claims arising from:

• Application bugs, glitches, crashes, or failures
• Data loss, corruption, deletion, duplication, or unavailability
• Security incidents, unauthorized access, or third-party misconduct
• Errors in records, statements, receipts, exports, messaging, inventory, or calculations
• Downtime, outages, service interruptions, or third-party failures
• User disputes, fraud, harassment, impersonation, or misuse
• Reliance on any content, record, communication, document, summary, report, or output generated or stored by the Service

To the maximum extent permitted by law, the total aggregate liability of Mozayel LLC for all claims arising out of or relating to the Service or these Terms shall not exceed the lesser of:

• The total amount you paid to Mozayel LLC for the Service in the twelve (12) months preceding the event giving rise to the claim
• Zero U.S. dollars (US $0), where permitted by applicable law

Some jurisdictions do not allow certain limitations of liability. In such cases, Mozayel LLC’s liability shall be limited to the fullest extent permitted by applicable law.

17. Indemnification

You agree to defend, indemnify, and hold harmless Mozayel LLC, its owners, officers, managers, employees, affiliates, contractors, service providers, successors, and assigns from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, judgments, settlements, fines, penalties, costs, and expenses, including reasonable attorneys’ fees and legal costs, arising out of or related to:

• Your access to or use of the Service
• Your content, data, records, files, communications, or user interactions
• Your violation of these Terms
• Your violation of any law, regulation, or third-party right
• Any dispute between you and another user, customer, vendor, or third party

18. Dispute Resolution and Arbitration

To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or related to these Terms, the Service, or your relationship with Mozayel LLC shall be resolved exclusively through final and binding arbitration rather than in court, except that Mozayel LLC may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property, confidential information, security, systems, or platform integrity.

You and Mozayel LLC each waive the right to a trial by jury and waive the right to litigate disputes in court, except as stated above or where arbitration is prohibited by applicable law.

19. Class Action Waiver

To the maximum extent permitted by law, you agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated, collective, representative, or private attorney general action. You waive any right to participate in any such action against Mozayel LLC.

20. Governing Law and Venue

These Terms and any dispute arising out of or relating to the Service or these Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of laws principles, except to the extent that mandatory local law requires otherwise.

For users operating in Afghanistan or other jurisdictions, you acknowledge that AFM may provide services used in or related to local operations, but these Terms remain governed by Washington law to the maximum extent permitted by law. Where mandatory local law applies and cannot be waived, those provisions will apply only to the limited extent required.

If a dispute is found not subject to arbitration, or if judicial action is otherwise permitted, the parties agree to the exclusive jurisdiction and venue of the state or federal courts located in Washington State, unless applicable law requires a different venue.

21. Termination and Suspension

Mozayel LLC may, at any time and without liability, with or without notice:

• Suspend, restrict, or terminate your access to the Service
• Remove or disable content
• Delete records, messages, files, or account data, subject to applicable law
• Modify or discontinue features

Termination or suspension does not relieve you of obligations that by their nature should survive, including indemnification, limitations of liability, dispute resolution, class action waiver, and intellectual property protections.

22. Payments and Refunds

AFM may offer free or paid features. Unless otherwise stated in a separate written agreement, all payments are final and non-refundable except where required by applicable law.

Mozayel LLC does not guarantee satisfaction, results, business value, accuracy, uptime, data preservation, or financial benefit in exchange for any payment.

23. International Use

The Service may be accessed from multiple countries. You are solely responsible for compliance with local laws applicable to your access to and use of the Service. Mozayel LLC makes no representation that the Service is lawful, appropriate, or available in every location.

24. Severability, No Waiver, Entire Agreement, and Changes

If any provision of these Terms is found unlawful, unenforceable, or invalid, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

Mozayel LLC’s failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

These Terms, together with any policies incorporated by reference, constitute the entire agreement between you and Mozayel LLC regarding the Service and supersede prior or contemporaneous understandings, communications, and proposals relating to the Service.

Mozayel LLC may update or modify these Terms at any time. Updated Terms become effective when posted, unless a later date is stated. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms.
